Terms of Service

These Terms of Use ("Terms") govern your access to and use of the Altinix website (the "Site") and services provided by Altinix ("Services"). By using the Site or Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using the Site or Services.

2. Services Provided

Altinix provides cloud-based GPU Virtual Machines (VMs) that offer high-performance computing resources for users engaged in tasks such as machine learning, AI, gaming, and other GPU-intensive workloads. Our VMs come with various GPU models (e.g., NVIDIA Tesla, Quadro, A100, etc.), and users can choose from various configuration options based on their needs.

We may update, modify, or discontinue the Services at any time without prior notice.

3. User Responsibilities

As a user of Altinix, you agree to:

  • Provide Accurate Information: You agree to provide true, accurate, and complete information during registration and maintain it as current and accurate.
  • Compliance with Laws: You agree to comply with all applicable local, national, and international laws and regulations regarding your use of the Services.
  • Usage Restrictions: You agree not to use the Services for any unlawful, harmful, or fraudulent activity, including but not limited to:
    • Unauthorized access to other networks or systems.
    • Activities that interfere with the operation or performance of the Services.
    • Engaging in activities related to hacking, spamming, or distributing malicious software.
  • Security: You are responsible for maintaining the security and confidentiality of your Altinix account, including your login credentials. You agree to notify us immediately if you believe your account or credentials have been compromised.

4. Billing and Payments

  • Payment Terms: By using the GPU Virtual Machines or other paid Services offered by Altinix, you agree to pay the applicable fees according to the pricing model specified on the Site.
  • Subscription and Renewals: Services are billed on a subscription basis (monthly or annually). Your subscription will automatically renew unless canceled before the renewal date.
  • Billing Cycle: Payments are due on the first day of each billing cycle. If payment is not received or cannot be processed, Altinix reserves the right to suspend or terminate your access to the Services.
  • Refunds: All payments are non-refundable except as required by applicable law or as specified in the refund policy, if any. We do not issue refunds for any partial use of the Services.

5. User Content

You retain ownership of any data, files, and content that you upload to our Services (“User Content”), but by using our Services, you grant Altinix a worldwide, royalty-free, non-exclusive license to store, host, and display your User Content for the purpose of providing the Services.

You are solely responsible for the User Content you upload, and you agree not to upload or store any content that is unlawful, infringing, or violates any third-party rights, including intellectual property rights.

6. Acceptable Use Policy

You agree to use Altinix Services only for lawful purposes and in compliance with all relevant laws and regulations. Specifically, you shall not use the Services:

  • For any illegal activities, including but not limited to unauthorized access, data breaches, or the dissemination of harmful malware or viruses.
  • To create, store, or distribute content that is obscene, offensive, harmful, or otherwise in violation of applicable laws.
  • To bypass or manipulate access controls, security systems, or content filtering mechanisms.

Any violation of these restrictions may result in the termination or suspension of your account, without refund, and may also result in legal action.

7. Service Availability and Uptime

We aim to provide high availability and uptime for our Services, but Altinix does not guarantee that the Services will be uninterrupted, error-free, or always available.

We will make reasonable efforts to provide you with prior notice of any scheduled maintenance or downtime, but Altinix will not be held liable for any loss of data, business interruption, or other damages arising from Service outages or downtime.

8. Termination and Suspension

Altinix reserves the right to suspend or terminate your access to the Services at its sole discretion, for reasons including but not limited to:

  • Non-payment of fees.

You may terminate your account at any time by notifying Altinix and discontinuing the use of the Services. Upon termination, your access to the Services will be revoked, and you will not be entitled to any refunds.

The Altinix Services are provided "as is," without any express or implied warranty of any kind, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non- infringement. Altinix does not guarantee that the Services will meet your requirements or that they will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, Altinix shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business, arising out of or in connection with your use or inability to use the Services, even if Altinix has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Altinix, its officers, directors, employees, and agents from any claims, losses, damages, or expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Services, violation of these Terms, or any breach of your representations and warranties.
